These Terms and Conditions govern the use of the website https://travelcostablanca.com (the “Website”) and the booking of tours and guiding services offered through it. By making a reservation or using this Website, you agree to be bound by these Terms and Conditions, in accordance with Spanish law.


1. Purpose of the Website

The Website provides information and booking services for guided tours, excursions, and related tourist services in Spain, offered by an official tourist guide.

A booking made through the Website constitutes a request for services and, once confirmed, forms a service agreement between the user and the service provider.


2. Booking Process

  • Bookings can be made through the Website booking form or by direct contact via email.
  • A booking is considered confirmed only after explicit confirmation by the guide, usually by email.
  • At present, bookings are made without online payment.

Future option: The Website owner reserves the right to introduce advance payment or deposit requirements for future bookings. Any such change will be clearly communicated before confirmation of the booking.


3. Prices and Payment

  • All prices are indicated in euros (EUR).
  • VAT (IVA) is included, where applicable.
  • Payment is currently made on the day of the tour.

Accepted payment methods: cash, bank transfer, card payment, and Bizum.

Prices may be updated at any time; however, the price confirmed at the time of booking will remain valid for that booking.


4. Cancellation and Refund Policy

This section is essential under Spanish consumer law.

  • Free cancellation is possible up to 24 hours before the scheduled start of the tour.
  • Cancellations made after this period may result in no refund/charge applies.
  • Failure to appear at the meeting point (“no-show”) will result in no refund, except in cases of force majeure (serious illness, accident, or other duly justified extraordinary circumstances).

In case of adverse weather conditions, the guide will contact the client to reschedule the tour for a mutually agreed date. If rescheduling is not possible, a full refund will be issued.

If the guide must cancel the tour due to force majeure (illness, safety concerns, or circumstances beyond reasonable control), the user will be offered a rescheduled date or a full refund.


5. Changes to the Tour

The guide reserves the right to make minor changes to the itinerary, route, or schedule due to organizational, weather, safety, or logistical reasons. Such changes do not constitute a breach of contract.


6. User Obligations

Participants agree to:

  • Arrive on time at the agreed meeting point
  • Follow the guide’s instructions during the tour
  • Behave respectfully toward other participants and third parties
  • Inform the guide in advance of any health condition that may affect participation

The guide reserves the right to exclude participants whose behaviour compromises safety or the quality of the tour.


7. Responsibility and Liability

  • Participation in tours is at the user’s own risk.
  • The guide is not responsible for loss, damage, or theft of personal belongings.
  • The guide is not liable for delays or incidents caused by third parties (transport providers, venues, weather conditions, public authorities, etc.).

The service provider holds a valid Civil Liability Insurance (Responsabilidad Civil) in accordance with Spanish legal requirements for professional tourist guiding activities.

Nothing in these Terms limits liability to the extent that such limitation is not permitted under Spanish law.


8. Minors

Minors may participate in tours only under the responsibility and supervision of their parents or legal guardians, unless otherwise stated.


9. Intellectual Property

All content on this Website, including texts, images, routes, and tour descriptions, is the intellectual property of the Website owner and may not be reproduced or used without prior written consent.


10. Applicable Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with Spanish law, in particular:

  • Spanish Civil Code (Código Civil)
  • Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users
  • Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE)
  • Applicable regional tourism regulations

Any disputes arising from the use of the Website or the provision of services shall be subject to the courts of Alicante, Spain, unless mandatory consumer protection rules provide otherwise.
